DOT Relaxes Applicability of Security Plan Requirements.
Under a revised rule that was published by DOT on March 9, 2010, certain low risk facilities are no longer required to maintain a Security Plan. Click Here To Read the Revisions.
Emergency Planning
EPCRA 312 (Tier I/II Reporting)
Facilities that have hazardous chemicals (as defined by OSHA in 29 CFR 1910.1200) on-site in excess of the following quantities must submit Tier II information to their fire department, LEPC, and SERC.
- Any extremely hazardous chemical in excess of the Threshold Planning Quantity (TPQ) or 500 pounds (whichever is lower)
- Any hazardous chemical in excess of 10,000 pounds
- 75,000 gallons of gasoline stored in an underground storage tank at a retail gas station
- 100,000 gallons of diesel stored in an underground storage tank at a retail gas station
Tier II information must be submitted annually by March 1 and covers the hazardous chemicals and extremely hazardous substances that were on-site during the previous calendar year.
EPCRA 311
EPCRA 311 requires that facilities provide an MSDS or list of hazardous chemicals to their fire department, LEPC, and SERC within 3 months of exceeding the following thresholds.
- Any extremely hazardous chemical in excess of the Threshold Planning Quantity (TPQ) or 500 pounds (whichever is lower)
- Any hazardous chemical in excess of 10,000 pounds
- 75,000 gallons of gasoline stored in an underground storage tank at a retail gas station
- 100,000 gallons of diesel stored in an underground storage tank at a retail gas station
